{"id":1391,"date":"2021-04-15T19:06:09","date_gmt":"2021-04-15T19:06:09","guid":{"rendered":"https:\/\/linsa.com.mx\/?p=1391"},"modified":"2021-04-15T19:06:09","modified_gmt":"2021-04-15T19:06:09","slug":"outsourcing-2021","status":"publish","type":"post","link":"https:\/\/linsa.com.mx\/en\/outsourcing-2021\/","title":{"rendered":"\u00bfC\u00f3mo ser\u00e1 la subcontrataci\u00f3n ahora?"},"content":{"rendered":"<div data-elementor-type=\"wp-post\" data-elementor-id=\"1391\" class=\"elementor elementor-1391\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-fb2e98e elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"fb2e98e\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-0e75341\" data-id=\"0e75341\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-8e18b4f elementor-widget elementor-widget-text-editor\" data-id=\"8e18b4f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>15 de abril de 2021<\/p><p style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">El Poder Ejecutivo lleg\u00f3 a un consenso con las empresas tras una negociaci\u00f3n de 5 meses que aminorara el impacto que la Reforma para eliminar la subcontrataci\u00f3n traer\u00eda para miles de empresas, tanto las que prestan un servicio como las que contratan.<\/span><\/p><p style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">Luego de que en diciembre quedara en espera, <strong>ha llegado el momento de acelerar la legislaci\u00f3n <\/strong>para que la reforma vaya porque vaya, sin mover nada de los acuerdos involucrando la Ley Federal del Trabajo, del Seguro Social, del C\u00f3digo Fiscal de la Federaci\u00f3n, Infonavit, ISR, <span style=\"letter-spacing: .1pt;\">Trabajadores al Servicio del Estado e IVA.<\/span><\/span><\/p><h4><span style=\"font-family: 'Arial',sans-serif;\">\u00bfC\u00f3mo quedar\u00e1n los acuerdos? \u00bfCu\u00e1l ser\u00e1 la ruta cr\u00edtica?<\/span><\/h4><p class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">A finales del 2020, se plante\u00f3 la <strong>iniciativa de la eliminaci\u00f3n radical del esquema Outsourcing<\/strong> y desde el 12 de noviembre hasta el reciente 14 de abril que se aprob\u00f3 por mayor\u00eda en lo general y en lo particular desde el pleno.<\/span><\/p><p class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">Podemos partir desde lo evidente, las empresas proveedoras de servicios como seguridad o limpieza por poner los m\u00e1s comunes, tienen en su objeto social que se dedican a ello, que <strong>prestaran un servicio especializado<\/strong> para otra persona f\u00edsica o moral y con la Reforma, lo que suceder\u00e1 es que tengan una mayor carga administrativa.<\/span><\/p><p class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\"><strong>El contratista solicitar\u00e1 toda la documentaci\u00f3n necesite incluyendo el permiso de la STPS,<\/strong> clave y\u00a0 del que hablaremos m\u00e1s, sin embargo, para aquellas empresas que se constituyeron bajo un \u201coutsourcing\u201d, pero hac\u00edan pr\u00e1cticas de simulaci\u00f3n, sin registrar trabajadores en el seguro social, sin cumplir con obligaciones fiscales, comprando facturas y sin los medios para comprobar su actividad principal, son las que desaparecer\u00e1n, a favor de los derechos a los trabajadores y de la erradicaci\u00f3n de malas pr\u00e1cticas o pr\u00e1cticas abusivas.<\/span><\/p><h3 class=\"MsoNormal\" style=\"text-align: center;\"><span style=\"font-family: 'Arial',sans-serif;\">\u00bfQu\u00e9 cambios habr\u00e1?<\/span><\/h3><p class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">Puede parecer confuso que se proh\u00edba o elimine la subcontrataci\u00f3n, pero que se puedan subcontratar servicios especializados u obras especializadas que:<\/span><\/p><ul><li class=\"MsoNormal\"><span style=\"font-family: 'Arial',sans-serif;\">No formen parte del objeto social <\/span><\/li><li class=\"MsoNormal\"><span style=\"font-family: 'Arial',sans-serif;\">No formen parte de la actividad preponderante <\/span><\/li><li class=\"MsoNormal\"><span style=\"font-family: 'Arial',sans-serif;\">Tengan el <strong>permiso otorgado por la STPS<\/strong> el cual se otorga cuando la persona f\u00edsica o moral cumple con: <\/span><ul><li class=\"MsoNormal\"><span style=\"font-family: 'Arial',sans-serif;\"><strong>Informaci\u00f3n Administrativa:<\/strong> Presentar cada 4 meses (enero, mayo y septiembre) contratos celebrados en el cuatrimestre, cantidad de personal, sus puestos. <\/span><\/li><li class=\"MsoNormal\"><span style=\"font-family: 'Arial',sans-serif;\"><strong>Informaci\u00f3n Fiscal:<\/strong> Cumplir con todas las obligaciones de ISR, IVA, etc. <\/span><\/li><li class=\"MsoNormal\"><span style=\"font-family: 'Arial',sans-serif;\"><strong>Informaci\u00f3n Laboral<\/strong>: Todo lo relacionado en materia de la LFT (Prestaciones).<\/span><\/li><\/ul><\/li><\/ul><p style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">Otro cambio importante es la eliminaci\u00f3n del esquema de retenci\u00f3n del 6% de IVA a partir del 31 de julio de este a\u00f1o y tendremos que estar pendientes del decreto del 1 de agosto para revisar los cambios en la Reforma una vez que toda la regulaci\u00f3n entre en vigor.<\/span><\/p><p style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\"><br \/>De acuerdo a cifras del INAI solo el 30% de las empresas cumplen cabalmente, el resto no es que no cumpla en totalidad, pero comenten errores o malas pr\u00e1cticas. A estas empresas se les podr\u00eda negar y\/o quitar el permiso en cualquier momento.<\/span><\/p><p style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">Todas las empresas estar\u00e1n supeditadas a auditor\u00edas o inspecciones y el permiso puede ser revocado. Existe el poder\u00a0 por la Secretar\u00eda del Trabajo y Previsi\u00f3n Social para fiscalizar, sin embargo cuando alguna de las otras instituciones como Infonavit o el SAT por ejemplo, identifiquen que una empresa no est\u00e1 cumpliendo, podr\u00e1n informar a la Secretar\u00eda y actuar en colaboraci\u00f3n.<\/span><span style=\"font-family: 'Arial',sans-serif;\"><br \/><\/span><\/p><h3 class=\"MsoNormal\"><b><span style=\"font-family: 'Arial',sans-serif;\">Los puntos que comprende la reforma son:<\/span><\/b><\/h3><ul><li class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">No poner a disposici\u00f3n trabadores propios en beneficio de otra.<\/span><\/li><li class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">Se permiten las agencias de empleo o intermediarios para reclutar, seleccionar, contratar y capacitar o entrenar personal, pero se considerar\u00e1n patrones. <\/span><\/li><li class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">Se permiten servicios u obras complementarias o compartidas prestadas entre empresas de un mismo <b>grupo empresarial<\/b> mientras no formen parte del objeto social ni de la actividad econ\u00f3mica preponderante de quien reciba el servicio. Las <em>insourcing<\/em> entran en la misma legislaci\u00f3n.<\/span><\/li><li class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">Se permite la subcontrataci\u00f3n de servicios u obras especializadas que no formen parte del objeto social ni de la actividad econ\u00f3mica preponderante siempre y cuando las empresas contratistas entren registradas en el padr\u00f3n p\u00fablico a cargo de la STPS.<\/span><\/li><li class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">Sanciones severas para outsourcing ilegal, incumplimiento de nuevas disposiciones o defraudaci\u00f3n fiscal con multas de 173 mil hasta 4 millones de pesos.<\/span><\/li><li class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">Deducci\u00f3n de pagos o contraprestaciones por subcontrataci\u00f3n de servicios especializados siempre y cuando el contratista cuente con el registro de la STPS y cumpla con los requisitos en la Ley del ISR y en la Ley del IVA.<\/span><\/li><li class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">La STPS tendr\u00e1 la facultad para auditar a la empresa y solicitar informaci\u00f3n de cumplimiento, en caso de negaci\u00f3n por parte del patr\u00f3n, habr\u00e1 sanci\u00f3n desde 22,400 hasta 44,810 pesos (250 a 500 UMAS)<\/span><\/li><li class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">La subcontrataci\u00f3n debe formalizarse con un contrato que se\u00f1ale el objeto del servicio a prestar.<\/span><\/li><li class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">Las empresas proveedoras de servicios (sub contrataci\u00f3n) deben contar con un registro ante la STPS, que sea p\u00fablico, disponible para consulta y renovarse cada 3 a\u00f1os.<\/span><\/li><li class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">Establecer responsabilidad solidaria por parte de la empresa contratista, es decir, que se abstenga de solicitar el servicio de empresas que no cumplan con sus obligaciones.<\/span><\/li><li class=\"MsoNormal\" style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">El monto de la participaci\u00f3n de los trabajadores en las utilidades (PTU) ser\u00e1 m\u00e1ximo de 3 meses de salario del trabajador o el promedio de la participaci\u00f3n recibida en los \u00faltimos 3 a\u00f1os, aplicando el monto que resulte m\u00e1s favorable al trabajador.<\/span><\/li><\/ul><h4>\u00a0<\/h4><h4>Algunas consideraciones<\/h4><p style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">Es importante no olvidar que toda esta regulaci\u00f3n, es para reconocer los derechos laborales de los trabajadores y evitar la simulaci\u00f3n. El expediente laboral y el permiso de la Secretar\u00eda ser\u00e1n ahora las herramientas para que las empresas prestadoras de servicio y las contratistas se puedan amparar, operar f\u00e1cil y eficientemente. <\/span><\/p><p style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">La subcontrataci\u00f3n sigue siendo para las Pymes y grandes empresas un apoyo para ser m\u00e1s productivos, que se enfoquen en sus negocios, resolver incidencias y optimizar procesos.\u00a0<\/span><\/p><p style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">Esta ley est\u00e1 prevista para que entre <strong>en vigor el pr\u00f3ximo 1 de mayo seg\u00fan los especialistas,<\/strong> que consideraron la premura que tiene el Gobierno por legislarlo y donde se cuentan aproximadamente 2 semanas desde que da luz verde La C\u00e1mara hasta la emisi\u00f3n de la gaceta parlamentaria.<\/span><\/p><p style=\"text-align: justify;\"><span style=\"font-family: 'Arial',sans-serif;\">A partir de la fecha en vigor, se les otorgar\u00e1 un plazo de <strong>3 meses a las empresas <\/strong>para registrar a sus trabajadores y formar parte de la n\u00f3mina del patr\u00f3n real, incluyendo sus pasivos y activos, y es que, al pasar de una empresa a otra, tambi\u00e9n lleva su antig\u00fcedad o la modalidad de las cotizaciones en Infonavit, cuestiones que no est\u00e1n muy claras al momento en esta iniciativa y que cuestionamos si est\u00e1n o no a favor del trabajador \u00bfTu qu\u00e9 piensas?
